Judge Rules Virginia School District Must Allow Transgender Student on Girls’ Tennis Team

A federal judge recently made a ruling that a Virginia school district cannot stop a transgender student from join a girls’ middle school tennis team while the student’s lawsuit against the county school board is proceeding.

Judge M. Hannah Lauck of the United States District for the Eastern district of Virginia issued this temporary injunction, stating that the 11-year old transgender  student in question would likely win her lawsuit against the schoolboard.

“Janie has established that the Board excluded her, on the basis of sex, from participating in an education program when it denied her application to try out for (and if selected, to participate on) her school’s girls’ tennis team,” Lauck wrote.

This ruling started because of an American Civil Liberties Union lawsuit on behalf of the transgender student who is said to identify as a female since the age of 11.

Not long after this ruling, the school board asked the student for medical documentation to confirm that he has been consistently expressing himself as a female.

A month later, the school board unanimously voted against allowing the student to try out or participate on the girls’ tennis team.

Details inside the lawsuit show that the student alleges the board discriminated against him in violation of Title IX and the 14tth Amendment’s Equal Protection clause.  But, the school board claims they need to ensure fairness in competition.
